Terms and Conditions of Use and Sale

These Terms and Conditions (the "Terms") apply to the website www.schneiders.com (the "Website") and to every purchase made through it.

The Seller is your contractual counterparty for every purchase: it accepts orders, collects payments, issues invoices, ships the Products and handles returns, refunds and the legal guarantee.

In these Terms, "we", "us" and "our" refer to Schneiders in relation to the use of the Website and its content (sections 4, 5, 6, 17 and 19), and to the Seller in relation to the sale of Products (sections 7 to 16 and 18).

2. Key points at a glance

• Please read these Terms carefully before using the Website or placing an order. By placing an order you accept them.
• Products on the Website are sold by Cashmere S.r.l. on behalf of Schneiders 1946 S.R.L. (section 1).
• We deliver only within the European Union. Delivery is free in Italy (section 12).
• Some clauses apply only to Consumers, or only to Users who are not Consumers. Where this is the case, the clause says so. All other clauses apply to everyone.
• Consumers resident in the European Union have a 14-day right of withdrawal and a 2-year legal guarantee of conformity (sections 13 and 14).
• Our online store is intended for end customers. Purchases for resale are not permitted (section 18).

3. Definitions

• User (or "you"): any person who uses the Website or buys Products through it.
• Consumer: a User acting for purposes outside their trade, business, craft or profession.
• European Consumer: a Consumer habitually resident in a Member State of the European Union.
• Products: the goods offered for sale on the Website, such as coats and outerwear.
• Schneiders: SCHNEIDERS 1946 S.R.L., owner of the Schneiders brand and of the Website.
• Seller: CASHMERE S.R.L., which sells the Products on behalf of Schneiders.
• Contract: the sale contract between the Seller and the User, formed as described in section 7.
• Coupon: a code or voucher that gives access to a discount or special offer.

4. User account

You may shop as a guest or create an account. Some features, such as order history, may only be available to registered Users.

When registering, you must provide complete and truthful information and keep your password confidential. You are responsible for all activity carried out under your account. If you believe your account or credentials have been compromised, please write to us immediately at info@schneiders.com.

You may close your account at any time by writing to info@schneiders.com.

We may suspend or close accounts used in breach of these Terms or of the law. Where the law requires it, we will give you prior notice and the reasons for our decision. Closing an account does not affect orders already placed and paid for.

5. Content and intellectual property

The trademarks "Schneiders" and "Schneiders of Salzburg", the logos, the designs and patterns of our garments, and all texts, photographs, images, videos and graphics on the Website belong to Schneiders or its licensors and are protected by intellectual property laws.

You may view the content for personal use while browsing and shopping. Unless we give written permission, you may not copy, download, modify, publish, distribute, sell or otherwise use it, nor allow others to do so. This does not affect any exception granted to you by copyright law.

We take care that the content on the Website does not infringe the rights of others. If you believe it does, please let us know at info@schneiders.com.

The Website may contain links to third-party websites, such as payment providers, carriers or social networks. We do not control those websites and are not responsible for their content or availability. Their own terms apply.

6. Acceptable use

You agree to use the Website only for its intended purpose and in compliance with these Terms and the law. We may restrict or deny access to the Website, cancel orders or report conduct to the competent authorities if a User:

• breaches the law or these Terms;
• infringes the rights of third parties;
• uses the Website fraudulently, for example with false identities or unauthorized payment methods;
• attempts to damage, overload or gain unauthorized access to the Website.

7. Products and orders

Product information

The main characteristics, composition, sizes, prices and availability of each Product are shown on its product page and may change without notice until an order is placed.

Our garments are made from natural materials, above all wool and loden cloth, and are made in Italy. Slight variations in shade, texture and finish are a natural feature of these materials and of garment making, and are not defects. Colors on screen may also differ slightly from the actual Product. Please refer to the size guide on each product page before ordering.

How to place an order

• Select the Products, size and quantity, and add them to your cart.
• Enter your shipping and billing details and choose the delivery and payment method.
• Review the order summary, including the total price, taxes and delivery costs, and correct any errors.
• Submit the order by clicking the button that confirms the obligation to pay.

When the Contract is formed

After you submit an order, we send an email acknowledging receipt. The Contract is formed when we send a second email confirming the order (the "Order Confirmation"), which includes a summary of the Contract and a link to these Terms.

We may decline an order, before sending the Order Confirmation, if a Product is no longer available, if the price shown was the result of an obvious error, or if the payment is not authorized. In that case we will inform you promptly and refund any amount already charged.

All communications about your order are sent to the email address you provide.

8. Prices

Prices are shown in euro and include VAT. Delivery costs are shown separately before you submit the order (see section 12).

The price that applies is the one shown at the time you submit your order.

9. Offers, discounts and Coupons

We may offer discounts or promotions at our discretion. Each offer is subject to its own conditions, shown on the Website or on the Coupon, which prevail over this section. Past offers do not create any right to future offers. Time limits refer to Italian time (CET/CEST).

Unless the conditions of the offer state otherwise:

• a Coupon must be used within its validity period and in full, in a single order;
• Coupons cannot be combined with each other or with other promotions;
• Coupons have no cash value, cannot be exchanged for money and, if the order value is lower than the Coupon value, the difference is not refunded;
• Coupons are for personal, non-commercial use only and may not be sold or reproduced.

If an order is placed using a Coupon in breach of its conditions, we may cancel the order or charge the undiscounted price, after informing you.

10. Payment

We accept payment by credit card and PayPal.

Payments are collected by the Seller and processed securely by third-party providers. Neither the Seller nor Schneiders receives or stores your card details. For information on how your personal data is handled, please see our Privacy Policy.

If the payment is refused or not completed, the order will not be processed.

Invoices

Invoices are issued by the Seller. If you need an invoice for your business, please email info@schneiders.com with your order number and company details (company name, address, VAT number and, for Italian companies, SDI code or PEC). We will get back to you within a few days.

11. Retention of title

Products remain the property of the Seller until the full price has been paid.

12. Delivery

We deliver only within the Member States of the European Union. Orders with a delivery address outside the European Union cannot be accepted. Products are delivered by courier to the address you indicate.

Delivery costs

• Italy: free standard delivery on all orders.
• Other European Union countries: EUR 35.00 per order.

Delivery times

Orders are normally processed within 1 to 3 business days for Italy and within 3 to 5 business days for other European Union countries. Transit time is added to processing time and counts business days only. During periods of high demand, processing may take longer. Items available on backorder are indicated as such and may ship later. If there is any delay, we will inform you by email as soon as possible.

Estimated delivery times are also shown during checkout. Unless otherwise stated, we deliver within thirty (30) days from the Order Confirmation. If we cannot deliver on time, we will let you know. If a Consumer's order is not delivered within the agreed time, or within any additional period the Consumer sets, the Consumer may terminate the Contract and receive a full refund.

For Consumers, the risk of loss or damage passes to you when you, or a person you have designated other than the carrier, take physical possession of the Products.

On delivery, please check that the parcel is intact. You may refuse a visibly damaged parcel, or accept it with a written reservation on the carrier's delivery note. Please report any damage or missing items to info@schneiders.com as soon as possible, ideally within 8 days, with photos. This does not limit your rights under the legal guarantee.

Failed delivery

We are not responsible for failed or late delivery caused by an incorrect or incomplete address supplied by the User. If the Products cannot be delivered or are not collected within the carrier's deadline, they will be returned to us and we will contact you to arrange a new delivery or a refund. The cost of a second delivery attempt is borne by the User, unless the failure is our fault.

13. Right of withdrawal

Who can withdraw

European Consumers may withdraw from the Contract within 14 days, without giving any reason. Users who do not qualify as European Consumers do not have this right, unless it is granted to them by the mandatory law of their country of residence.

Withdrawal period

• The period expires 14 days after the day on which you, or a third party you designate other than the carrier, take physical possession of the Products.
• If you ordered several Products in one order and they are delivered separately, the period expires 14 days after you receive the last one.

How to withdraw

Send us a clear statement of your decision before the period expires, by email to info@schneiders.com or by letter to the Seller at the address below. You may use the model withdrawal form in the Annex, but this is not mandatory.

Returning the Products

You must return the Products without undue delay, and in any case within 14 days from the day you told us of your decision, to the Seller at the following address: Cashmere S.r.l., Strada Trossi 72, 13871 Verrone (BI), Italy. Please include your order number. The deadline is met if you hand the Products to the carrier before the 14 days have expired.

The direct cost of returning the Products is borne by you. We will reply to every return request within 5 business days.

You may handle the Products only as you would in a shop, to establish their nature, characteristics and fit. You are liable for any loss in value caused by other handling, for example if a garment has been worn, washed, altered, damaged or returned without its original labels. We ask you to return Products with their tags attached and in their original packaging where possible.

Refund

We will refund all payments received for the returned Products, including standard delivery costs, without undue delay and in any case within 14 days from the day we received your withdrawal notice. We will not refund the extra cost of any delivery method you chose that is more expensive than our cheapest standard delivery. We may withhold the refund until we have received the Products back or you have supplied proof of shipment, whichever is earlier.

The refund is made using the same payment method you used for the purchase, unless you expressly agree otherwise, and at no cost to you.

Exceptions

The right of withdrawal does not apply to Products made to measure or clearly personalized at your request, such as garments with custom sizing, monograms or modifications.

Exchanges and store credit

Instead of a refund, you may choose to exchange the Product or to receive a voucher for store credit. This option is in addition to, and does not replace, your right to a refund. To request it, write to info@schneiders.com stating the item you would like instead. Products must be unworn, unwashed and with their original tags.

• If the new item costs less than the returned one, we will ship it when your return arrives and email you a voucher for the difference.
• If the new item costs more, we will email you a voucher for the full amount you paid, which you can use towards the new item.
• Vouchers are valid for 12 months from the date of issue.

After the withdrawal period has expired, refunds are no longer available, but we may still offer an exchange or store credit at our discretion, under the same conditions.

14. Legal guarantee of conformity

All Products are covered by the legal guarantee of conformity for Consumers set out in Articles 128 et seq. of the Italian Consumer Code (Legislative Decree no. 206/2005). The Seller is liable for any lack of conformity that becomes apparent within 2 years from delivery.

If a Product is not in conformity, you are entitled to have it repaired or replaced free of charge or, where that is not possible or not done within a reasonable time, to a price reduction or termination of the Contract. To use the guarantee, please contact info@schneiders.com describing the issue and attaching your order number and photos.

European Consumers may also benefit from any broader rights under the law of their country of residence. Normal wear, damage caused by improper use or care, and the natural variations described in section 7 are not a lack of conformity.

For Users who are not Consumers, the warranty provisions of the Italian Civil Code apply (Articles 1490 et seq.), including the requirement to report defects within 8 days of discovery.

15. Liability

Nothing in these Terms excludes or limits the liability of the Seller or of Schneiders for death or personal injury caused by our negligence, for fraud or gross negligence, or any right that Consumers cannot waive under the law that applies to them.

Subject to the above, neither the Seller nor Schneiders is liable for:

• temporary unavailability or interruptions of the Website due to maintenance, technical faults or events beyond our reasonable control;
• damage caused by viruses or unauthorized access to the User's devices or account, unless caused by our failure to take reasonable security measures;
• the content of third-party websites linked from the Website.

For Users who are not Consumers, the Seller's total liability arising from any Contract is limited to the price paid for the Products concerned, and the Seller is not liable for indirect damage or loss of profit, to the extent permitted by law.

Users outside the European Union

To the extent permitted by the law of the User's country of residence, the Website is provided "as is" and "as available", and we disclaim any warranty not expressly stated in these Terms. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you, and you may have additional rights under local law.

16. Indemnification

To the extent permitted by law, you agree to hold Schneiders and the Seller harmless from any claims, costs and damages, including reasonable legal fees, arising from your breach of these Terms, your violation of the law or of third-party rights, or unauthorized use of the Website under your account due to your fault.

17. Website availability

We may temporarily interrupt the Website for maintenance or updates, informing Users where possible. We may also discontinue the online store. In that case, orders already confirmed will be fulfilled or refunded and your statutory rights will not be affected.

18. No resale

The online store is reserved for end customers. You may not purchase Products for resale, nor reproduce, copy or commercially exploit any part of the Website without the prior written consent of Schneiders. Retailers interested in stocking Schneiders may contact us at info@schneiders.com. We may decline or cancel orders that, by quantity or other circumstances, appear to be intended for resale.

19. Privacy

Your personal data is processed by Schneiders and by the Seller, each for its own purposes, in accordance with Regulation (EU) 2016/679 (GDPR). Please see the Privacy Policy at [link to Privacy Policy] for details.

20. Changes to these Terms

Schneiders and the Seller may update these Terms from time to time, and will inform Users appropriately. Each order is governed by the version of the Terms in force when it was submitted. The version applicable to your order is included in, or linked from, your Order Confirmation. Previous versions are available on request.

21. Assignment

Schneiders and the Seller may transfer their rights and obligations under these Terms to another company, taking your legitimate interests into account and without reducing your rights. You may not transfer your rights or obligations without our written consent.

22. General provisions

If we do not enforce a right under these Terms, this does not mean we waive it. If any provision is found invalid or unenforceable, the remaining provisions stay in full force and the invalid provision will be replaced, where possible, by the applicable legal provisions or by a valid provision as close as possible to its original purpose.

23. Governing law and jurisdiction

These Terms and every Contract are governed by Italian law. Consumers retain the protection of any mandatory provisions of the law of their country of habitual residence that grant them a higher level of protection.

For disputes with Users who are not Consumers, the Court of [Biella] has exclusive jurisdiction over disputes relating to Contracts, and the Court of Milan over disputes relating to the use of the Website. For disputes with Consumers, the court of the Consumer's place of residence or domicile has jurisdiction, as provided by law.

24. Complaints and dispute resolution

If you have a complaint, please write to info@schneiders.com with a brief description and, where relevant, your order number. We will reply without undue delay and in any case within 21 days.

The European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228. Consumers may still use the alternative dispute resolution (ADR) bodies available under the Italian Consumer Code, and may always bring legal action before the competent court.
